Definitions:
1. ADARSH REALTORS: Deemed to mean and include administrators, executors, successors, employees, staff & permitted assignees, further referred as Company.
2. DEVELOPER / PROMOTER: A person who constructs an independent building or a building, apartments, or converts an existing building or a part thereof into apartments, or a person who develops land into a project, or the person also constructs structures on any of the plots, for the purpose of selling to other persons, whether with or without structures for the purpose of selling all or some of the units (apartment, flats, plots etc.) to other persons and includes his assignees.
3. MOBILE APPLICATION:Software /App designed by ADARSH REALTORS, to run on android or apple mobile device or web, such as a smart phone or tablet or computer, further referred as “App”.
4. REAL ESTATE PROJECT: Means the development of a building or a building consisting of apartments, or converting an existing building or a part thereof into apartments, or the development of land into plots or apartment, as the case may be, for the purpose of selling all or some of the said apartments or plots or building, as the case may be, and includes the common areas, the development works, all improvements and structures thereon, and all easement, rights and appurtenances belonging thereto, further referred as “ PROJECT”.
By accessing the App or any of its pages thereof or by making any booking thereto, you are expected to have read and agreed tothe following terms and conditions:
1. The information in the App, including all text, images, names, pictures, layouts, perspectives, drawings, graphics, models, logos, links, icons, and other items are shown for approximate and for illustration purpose only. We do not doubt the plans but we make no guarantee, warranty representation as to the accuracy. They cannot be construed as legal advice.
2. You are advised to tally or verify the project information from Rajasthan Real Estate Regulatory Rules, 2017 website (http://rera.rajasthan.gov.in) also.
3. Hot list & other project listing are for limited period and can be altered, amended or discontinued, depending upon the agreement between the Developer and theCompany.
4. Unit will be reserved for a period of 30 days from the date of reservation of property. The total dues towards the unit have to be paid by the purchaser within 30 days or else it will be treated, as default in booking Developer is free to take action against such booking as per the policies.
5. Construction of the project, development of common facilities etc. will be in accordance to the policy of developer. Read all the terms & conditions of developer carefully.
6. Payment made to developer is purely against the purchase of property and shall not attract any interest or penalty.
7. Home Loan is subject to eligibility of an individual and may vary in all Financial Institutions.Company does not undertake any commitment as to interest, eligibility, disbursement etc. on Home Loan.
8. GST and other taxes on project / property will be charged as applicable by Government and the policy of the developer.
9. Company is not liable to pay any penalty & interest on the delay of the project, booking cancellation, refund etc.
10. Company does not guarantee any buyback, resale, assured return or return on investment at any point of time.
11. Cancellation of any booked unit would be based in accordance with Developers conditions; any cancellation of booked unit must be requested with a minimum notice of 2 months or more. This does not entitle a refund of the paid cancellation values.
12. Any of the notices by the developer or Company shall be sent to the address of the first applicant only.
13. Some links within the App may lead to other web sites, which may include those operated by third parties. Company includes these links only as a convenience for you, and the presence of such links do not imply a responsibility for the linked site or any endorsement of the linked site or its operator, or its contents.
14. The access and use of any information contained in the App are at the risk of the user. Company or any of its associates, subsidiaries, affiliates, marketing partners, suppliers, agents, officers, or employees under any circumstances would not be liable for any damages, losses, expenses and costs and expenses whatsoever whether in an action in negligence, contract, or tort arising out of connection with.
15. Company shall not be held liable for any time difference between any transactions through a gateway / server problem.
16. Company shall not be responsible for the advice, views & suggestion provided. The information contained herein should be used for reference only.
17. ThisApp may have links to other websites, that are not under the control of Company and the opinions, contents and other links provided are not investigated, monitored or verified by Company. The company will not be held responsible for the opinions, contents, or other links in any such linked websites. Such links are not an endorsement by the Company, and you are put on notice that any access of such linked websites is at your own risk.
18. The failure of error, performance, defect or omission of any network, server system or line or the transmission to any mobile software or hardware in accessing thisApp with any computer virus and other corrupting or destructive codes, macros, programs, or elements of any kind.
19. Company is not liable to provide any prior information to its users before making any up gradations in the policies.
20. Management reserves the right to change, amend, modify, suspend, continue or terminate all or any part of the plan at any time without notice.
21. In case of any dispute, decision of the Company Management will be final and binding.
